Regulation theories focus primarily on the behavior of regulatory agencies. In this article, the authors elevate the level of analysis to study the disputes these agencies address. This change of analytic level has two advantages. First, it highlights the importance of other forms of dispute resolution. Second, it provides for specific dispute resolution strategies. The article uses systems and behavioral theories as the underpinnings of a broad model of societal regulation that offers strategies for avoiding and managing societal disputes.

This three-part analysis of modernity assesses the impact that Western thought and philosophy has had on today's world. Making use of neglected research from the fringes of academia, "Anatomyzing Divinity" traces the circuitous path of occult wisdom from China, India, Egypt and the Hellenistic world to Byzantium and beyond. At the heart of the book is an investigation of the life and thought of G. W. Leibniz, the man who invented calculus and laid the groundwork for binary code, which in (...) turn made computers possible. Leibniz's roots, Kelley shows, lay in the Frankish metaphysical tradition, and thus have little in common with some of his contemporaries' materialism. Cognitive control constrains retrieval processing and so restricts what comes to mind as input to the attribution system. We review evidence that older adults, patients with Alzheimer's disease, and people with traumatic brain injury exert less cognitive control during retrieval, and so are susceptible to memory misattributions in the form of dramatic levels of false remembering.

The income and careers that come with building wind turbines have become a lifeline for many factory towns and farming communities. Generating electricity from the wind puts increasingly cheap power on the grid, saving consumers billions a year. And it is one of the biggest, fastest, cheapest ways to reduce carbon pollution, reducing the threat of climate change. Yet as wind farms have rapidly spread to forty‐one states, their developers must make their case anew with each community that hosts them. (...) Kelley It was just sixty years ago that this Journal first made its appearance. Two hundred thirty-nine issues later it continues in a world transformed by war, overpopulation, cultural shocks, scientific and technological transformations, globalization, the avalanche of information produced by electronic exchange, and "the acceleration of just about everything." Yet (...) despite these factors and the strains of postmodernism and cultural alterity, 1 it has not entirely lost touch with its intellectual innocence, faith in humanistic learning, and reliance on enlightened reason. This continuity itself may seem something of a novelty in an age of distrust of history and "rage against reason," but for some of us it reflects the critical spirit and intellectual context out of which such ostensibly subversive attitudes emerge, and reemerge. To some extent, moreover, the diversity of opinions about intellectual traditions is the result of specializations, and special interests, which have changed the climate of opinion since the time of Arthur O. Lovejoy, principal founder of the JHI. Lovejoy's vision was super- as well as inter-disciplinary; that is, he intended to include in the agenda of "history of ideas" particular areas of history of philosophy, literature, art, science, social science, etc., as well as the larger intellectual and cultural areas into which these disciplinary histories extend. 2 These days, however, all these disciplinary traditions have their own more specialized journals and do not need to seek a vehicle in publications of more general interest. What remains then, for the most part, is the interdisciplinary arena in which larger questions of human experience should be posed--and for Lovejoy, as for so many epigones and critics, the main "larger question" is not only one of value but also of specifically historical inquiry. 3 [End Page 153]The first issue of the JHI appeared under the editorship of Lovejoy (with Philip Wiener, who did most of the editorial work, as "managing editor"), assisted by a committee that included two historians, three philosophers, four literary scholars, and one political theorist; namely, Crane Brinton, Gilbert Chinard, Morris Cohen, Francis Coker, Richard McKeon, Perry Miller, Marjory Nicolson, J. H. Randall, J. Salwyn Schapiro, and Louis Wright. The first volume featured contributions from each of these, including Wiener, except for Miller (vol. 2), Shapiro (vol. 3), McKeon (vol. 8), and Coker. 4 During the first five years there were also reviews of books by Dilthey (by Horace L. Friess), Croce (Schapiro), Mannheim (Randall), Perry Miller (Herbert W. Schneider), Van Wyck Brooks (Miller) and Alfred Kazin (F. O. Matthiessen). In this period the disciplinary distribution of articles was not markedly different from that of the past five years, nor was the ranking of fields by number of submissions. 5 Most important, the original interdisciplinary thrust of Lovejoy's agenda, if not his attachment to the spiritualist currency of "unit-ideas," has survived growing specialization.At first the history of ideas was pursued largely in the shadow of the history of philosophy; for in this field, according to Lovejoy, "is to be found the common seed-plot, the locus of initial manifestation in writing, of the greater number of the more fundamental and pervasive ideas, and especially of the ruling preconceptions, which manifest themselves in other regions of intellectual history." 6 Lovejoy's concern was always with concepts, especially "-isms," and yet in some ways he anticipated the "linguistic turn" of the later years of this century, pointing out in particular "the role of semantic shifts, ambiguities, and confusions, in the history of thought and taste," for "nearly all of the great catchwords have been equivocal--or rather, multivocal." 7 If ideas could be given stable definitions, they were nonetheless often, in the context of language, in conflict, even in the mind of a single thinker; for such was the "anomaly of knowledge." 8 So Lovejoy was at pains to distinguish the various meanings of [End Page 154] catch-words like "nature," "perfectibility," "romanticism," "progress," and "pragmatism," not to mention more inflammatory terms of wartime ideological debate.But... Toutefois, le développement de nouveaux traitements et de nouvelles technologies, en particulier des produits pharmaceutiques, ont fait naître un nouveau débat sur la gestion de notre système de santé. En se basant sur une analyse récente des valeurs libérales dans la société québécoise par Claude Ryan, l’auteur souligne l’importance que le gouvernement doit accorder à ces valeurs dans (...) la modernisation de notre système de santé. À la lumière des recommandations présentées par la commission Clair au provincial et par la commission Romanow au fédéral, la situation se prête bien à une modernisation du système de soins au Québec. L’implantation d’une nouvelle technologie est une étape de la translation d’une découverte vers une application clinique. De nombreux modèles ont été proposés pour étudier une telle translation ; celui de Goering, Holland et Kelley met de l’avant des priorités qui résonnent avec la bioéthique. Nous proposons l’application d’un outil issu des sciences de l’implantation, le Consolidated Framework for Implementation Research (CFIR), pour identifier les enjeux éthiques d’une nouvelle technologie. Cet outil est conçu pour identifier les barrières et facilitateurs de (...) l’implantation d’une technologie, et par le fait même s’inscrit dans le modèle de la recherche translationnelle. Nous prenons en exemple le test génomique prénatal non invasif (TGPNI). Ce test est offert dans certaines provinces du Canada en deuxième intention pour les personnes enceintes ayant une haute probabilité d’avoir un foetus avec une aneuploïdie. Des innovations potentielles du TGPNI sont de l’offrir comme test de première intention et d’étendre le nombre de conditions génétiques dépistées. Nous proposons donc d’utiliser le CFIR pour identifier les enjeux éthiques qui découlent des barrières et facilitateurs de ces innovations du TGPNI. En identifiant les barrières et facilitateurs de l’implantation d’une technologie, cet outil permet aux bioéthiciens de recourir à un outil éprouvé d’une autre discipline pour étudier des enjeux éthiques. Les bioéthiciens peuvent alors se tourner vers leurs outils traditionnels pour identifier les enjeux éthiques que soulèvent ces éléments. Notre proposition est un exemple parmi d’autres possibles de ce que cette approche peut accomplir : identifier d’une manière innovatrice des enjeux éthiques d’une nouvelle technologie. (shrink)

L’une des dernières œuvres de Mike Kelley, qui comprend plusieurs séries réalisées entre 1999 et 2011, est consacrée à Kandor, la ville natale de Superman sur la planète Krypton : une architecture phallique miniaturisée, maintenue sous cloche dans une atmosphère séparée, et dont la forme, dans les vignettes des comics d’origine, ne cesse de subir des variations au fil des épisodes. Partant de ces dessins à la mémoire labile, Kelley produit un ensemble d’installations multimédias qui reprennent des codes (...) visuels typiques de la science-fiction, mais dont l’expérience, pour le spectateur, s’avère excluante plutôt qu’immersive. D’un point de vue phénoménologique, il est question d’appréhender les Kandors comme des réticences, et d’interroger les différents enjeux de cette présence paradoxale. Porteuses de fonctions complexes à la portée psychique autant que collective, ces installations sont d’abord des paraboles du conditionnement social et de ses moules, ce qui inclut et met à l’épreuve leurs propres modalités de réception critique. Par ailleurs, les Kandors engagent tout un jeu de réminiscences formelles qui questionne les mécanismes de fabrication de la mémoire officielle, et la relation amnésique que celle-ci entretient avec certains types de formes principalement issues de la culture populaire. One of Mike Kelley’s latest works, which includes several series produced between 1999 and 2011, is dedicated to Kandor, Superman’s hometown on the planet Krypton: a miniature phallic architecture, kept in a bell jar in a separate atmosphere, and the form of which, portrayed in the original comic strips, continues to undergo change through each episode. Based on these labile memory drawings, Kelley produces a set of multimedia installations which draw from Sci-Fi visual codes, but the experience of which, for the viewer, is exclusive rather than immersive. From a phenomenological point of view, we must consider the Kandors as reluctances, and question the different stakes of this paradoxical presence. Carrying complex functions with psychic as well as collective scope, they will first be seen as parables of social conditioning, including their own critical reception. Moreover, the Kandors imply a whole game of formal recollections which questions the mechanisms of manufacturing official memory, and the amnesic relationship which this maintains with certain types of forms derived mainly from popular culture. Non a caso, come osserva Jane O’Grady, talvolta venne soprannominata la Dragon Lady di Oxford. Basti citare la sua opposizione pubblica al conferimento della laurea honoris causa al presidente Truman, o alle sfide che fronteggiò in campo morale. Autrice di numerosissime pubblicazioni, nel 1958 stilò il famoso scritto Modern Moral Philosophy, poi divenuto il manifesto della rinascita di un’etica di tipo neo-aristotelico. Alfred J. Freddoso ; pref. Norman Kretzmann. Vol. l of the Yale Library of Medieval Philosophy. New Haven and London: Yale University Press, 1991. Pp. 391 and 305. $100.00 for both (cloth). In these handsome volumes, Professor Alfred J. Freddoso and the late Professor Frank E. (...) Kelley have provided the scholarly community with an English translation of William of Ockham's Quodlibeta septem (hereafter QS). The volumes constitute the first volume in the new Yale Library of Medieval Philosophy, and both the new series and this first contribution within it will add generously to the growing num· her of medieval philosophical texts available in English. Using the critical edition of Ockham's Latin text established by the Rev. Joseph C. Wey (Opera theologica, vol. 9, Franciscan Institute: St. Bonaventure, NY, 1980) as the basis for their work, the translators offer to readers of English an accurate translation of one of Ockham's mature theological works, treating a wide variety of philosophical and theological topics. Indeed, thanks to their efforts, the broad range of Ockham's thought in natural and revealed theology, ontology, epistemology, and ethics becomes available in English for the first time. The purpose of the Yale series is to translate into English " complete works of philosophical and historical importance". In deciding which work of Ockham to translate for the series, the translators faced two potential hazards: the danger of translating one of Ockham's earlier works that might contain ideas which he subsequently reconsidered; and the danger of translating a work that focused upon a narrow range of topics, something which would give readers the false impression that Ockham's philosophy was concerned only with those topics. The translators have adroitly managed to avoid both of these potential hazards. The translators certainly steered clear of the first hazard by deciding to translate Ockham's QS. These quodlibetal questions are believed to represent the substance of disputations Ockham held at the Franciscan studium in London during the years 1322-1324, although the final written form of the work probably was not established until 1325 or shortly thereafter at Avignon. Hence the QS represent to a large extent Ockham's final word on the topics discussed, since in the period after 1325 up until the time of his death in 1347 Ockham was too heavily embroiled in ecclesiological and political controversies in Avignon and Munich to give much consideration to more speculative concerns. Yet the translators also avoided the second hazard by choos- 338 BOOK REVIEWS ing to translate the QS. True, the QS is akin to numerous other medieval quodlibetal questions in that it treats an array of questions; hut, in the case of Ockham's work, the range of topics is so broad and the issues broached therein so fundamental to his personal thought that one has, in effect, a compendium of Ockham's major philosophical and theological ideas. A brief glance at the table of questions indicates the breadth of the questions and their relevance to perennial philosophical discussions. In the area of philosophical theology, Ockham asks whether it can be proved by natural reason that there is only one God; whether it can be proved by natural reason that God's power is infinite; whether God could have made the world from eternity. In regard to ethical theory, Ockham asks whether the exterior act has its own proper moral goodness, and whether there can be a demonstrative science about morals. In fields of epistemology and the philosophy of mind, Ockham asks whether the human intellect knows its own acts intuitively in this life; whether it knows sensible things intuitively; and whether there can be an intuitive cognition of a non-existent object. Closer to the area of logic and semantics, Ockham raises several questions about the status of propositions and their components: whether a mental proposition is composed of things or concepts; whether mental names are divided into concrete and abstract names in the manner of spoken names; whether the object of a definition is an extra-mental reality or a concept. Conceptions of autonomy in western philosophy and ethics have often centred on self-governance and self-determination. However, a growing bulk of literature also questions such conceptions, including the understanding of the autonomous self as a self-governing independent individual that chooses, acts, and lives in accordance with her or his own values, norms, or sense of self. This article contributes to the critical interrogation of selfhood, autonomy, and autonomous decision making by combining a feminist focus on relational dimensions of selfhood and autonomy (...) with phenomenological philosophy of the embodied self as being-in-the-world. It offers a philosophical investigation of different dimensions of bodily relational autonomy by turning to phenomenological accounts of the lived body as self-reflexive. When so doing, we hope to contribute to bridging the gap that sometimes exists between discussions of autonomy in analytic moral philosophy and of freedom and facticity in phenomenological philosophy. We see this gap as unfortunate, and hold that a nuanced understanding of autonomy and autonomous decision making can be reached if these strands of philosophy are brought into dialogue. (shrink)
